In this arrangement, the recipient becomes the legal owner of the depot, but the original owner retains the right to the income generated by the assets, such as dividends and interest. The grantor may also reserve extensive rights of participation or control.

For instance, if a 60-year-old father gifts a €800,000 depot with a 4% annual return to his daughter, the capital value of the usufruct could be approximately €409,536. From the perspective of the tax authorities, the taxable amount for the daughter would then be reduced to around €390,464, potentially falling within her tax-free allowance if no other gifts have been received within the last ten years.

While offering substantial tax advantages, usufructuary arrangements require careful planning. "The transfer of a depot is generally final," warns Dorn. "Those who gift assets should consider their own financial security." It is advisable to include provisions in the gift agreement for the return of assets under specific circumstances, such as the recipient’s insolvency, divorce, or predecease.

Furthermore, the grantor cannot unilaterally terminate the usufruct. "The gratuitous waiver of usufruct can itself be considered a gift," notes Dorn. An alternative could be the financially compensated release of the usufruct. In certain scenarios, this compensation may not be considered taxable income for the grantor, thus avoiding income tax.
